3. Consumer and B2B
Customers
A consumer is generally an individual
purchasing wholly or mainly outside their trade, business, craft or
profession.
A B2B customer is a company, partnership,
sole trader or other organisation purchasing wholly or mainly for purposes
connected with its trade, business, craft or profession.
Where you are a consumer, nothing in these
Terms removes or restricts your statutory rights.
Where you are purchasing for business
purposes, the B2B provisions of these Terms apply.
4. Standard Stock
Products
Only standard stock items are
currently available for direct purchase through the website.
Standard stock products are supplied as
described on the relevant product page without modification to the
customer's individual requirements.
Most standard stock items are made to order
following purchase, even though they are classified as standard stock
items.
The normal manufacturing/dispatch period is
up to 5 working days.
All standard stock products purchased
online must be paid for in full at the time of order using the
PayPal payment facility provided on the relevant product page.
This applies to both consumer and B2B
customers.
Standard stock products are not supplied on
credit.
5. Modified Stock and
Bespoke Products
Modified stock products and fully bespoke
products are not available for direct online purchase.
Customers requiring:
- a modification to a standard product;
- a product manufactured to their own
measurements;
- a product manufactured to their
drawings;
- a product manufactured to their
specifications; or
- a completely bespoke product
must contact us before placing an order.
A quotation and specification will be
agreed where appropriate before manufacture begins.
Modified Stock Items
A modified stock item is a standard product
that has been altered or adapted at the customer's request.
Fully Bespoke Items
A fully bespoke item is manufactured specifically
to the customer's individual requirements, measurements, drawings,
specifications or instructions.
6. Fabrication Services
Pages describing fabrication work
undertaken by Tigweld4u Limited are provided for information and portfolio
purposes.
Photographs and descriptions of previous
work do not constitute an offer to sell an identical product or indicate
that the product is available for direct online purchase.
Customers requiring fabrication work should
contact us to discuss their requirements.
B2B fabrication work undertaken by
Tigweld4u Limited is treated as bespoke fabrication unless otherwise agreed
in writing.
This includes goalpost door protection.
Although some components may be common
between orders, the goalposts themselves are manufactured to dimensions
supplied by the individual customer and the overall order is therefore
treated as bespoke.
7. Fabrication
Quotations, Delivery and Lead Times
For bespoke fabrication work, the quotation
will state, as applicable:
- the cost of the items being
manufactured;
- the estimated manufacturing lead time;
- the delivery cost;
- the estimated delivery time; and
- any other agreed costs.
Delivery costs for fabricated items are
calculated according to factors including:
- delivery location;
- size; and
- weight.
For large or unusually sized fabricated
items, delivery may be carried out by a subcontracted haulage company or
specialist transport provider.
Manufacturing and delivery lead times are
estimates unless a specific date has been expressly agreed in writing.
8. Product Descriptions
and Vehicle Compatibility
We make reasonable efforts to ensure that
product descriptions, photographs and specifications are accurate.
Customers are responsible for checking that
a product is suitable for their intended vehicle or application.
Where a known compatibility issue or
vehicle-specific requirement applies, this will be stated in the relevant
product description where appropriate.
If you are unsure whether a product is
suitable, please contact us before ordering.
9. Customer-Supplied
Information
Where we manufacture or modify a product
using customer-supplied measurements, drawings, specifications or other
information, the customer is responsible for ensuring that the information
supplied is accurate.
Where incorrect information supplied or
approved by the customer results in additional work, reasonable additional
costs may apply.
10. Prices and VAT
Where Tigweld4u Limited is the supplier,
prices include VAT at the applicable rate.
Where Tigweld4u Customs Limited is the
supplier, VAT is not charged because the company is not VAT registered.
Delivery charges may be displayed
separately or quoted separately.
For bespoke fabrication work, the delivery
cost and estimated manufacturing and delivery lead times will be quoted
together with the cost of the work.
11. Pricing and Stock
Errors
We make reasonable efforts to ensure that
prices, stock availability and product information are accurate.
If an obvious pricing error occurs, or an
item shown as available is subsequently found to be unavailable, we reserve
the right to cancel the affected order and provide a full refund.
We will notify the customer as soon as
reasonably practicable.
12. Payment
Online standard stock products are
purchased using PayPal buttons.
PayPal may allow customers to pay using a
PayPal account or an eligible payment card.
We do not operate a separate direct
card-payment facility.
B2B Fabrication
B2B fabrication work supplied by Tigweld4u
Limited may be subject to credit terms where these have been expressly
agreed with the customer in writing.
Credit is not automatically available
to B2B customers.
Where credit terms are agreed, the
applicable payment period will be stated in the quotation, order
confirmation, invoice or other written agreement.
Bank-transfer details are provided on our
invoices.
13. Formation of an
Online Contract
For standard stock products purchased
through a PayPal button, the order is accepted when the customer
successfully places the order through the PayPal purchasing process,
subject to our rights concerning obvious pricing errors, stock availability
and other circumstances permitted by these Terms.
14. Delivery
We deliver vehicle parts within the UK and
internationally where international delivery is available.
Certain products may be restricted to UK
delivery. Any such restriction will be stated on the relevant product page.
Fabrication work and associated delivery
services are currently UK only unless otherwise agreed.
The normal dispatch period for standard
vehicle parts is up to 5 working days.
Normal UK delivery after dispatch is
approximately 24–48 hours, although this is an estimate rather than
a guaranteed delivery period.
International delivery times vary according
to destination and delivery service.
15. Delivery Companies
and Haulage Providers
We may use:
- Transglobal Express;
- DHL;
- Royal Mail; and
- subcontracted haulage companies or
specialist transport providers for large fabricated items.
The delivery provider used may depend upon
the product, destination, size, weight and delivery requirements.
16. Delivery Insurance
Goods sent by courier are insured
against loss or damage during transit, subject to the terms, conditions
and limitations of the applicable courier or transport insurance.
Where goods are lost or damaged, we will
deal with the relevant courier or transport provider and, where
appropriate, make a claim under the applicable insurance.
Customers should report loss or damage to
us as soon as reasonably possible and provide photographs or other
information reasonably requested.
17. Collection
Collection may be available by prior
arrangement.
Customers wishing to collect an order
should contact us before travelling to ensure the goods are ready.
18. Risk and Delivery
For consumer purchases, risk in goods
passes in accordance with applicable consumer legislation.
For B2B purchases, risk passes in
accordance with the agreed contractual terms and applicable law.
19. Retention of Title –
B2B Fabrication
Where Tigweld4u Limited supplies
fabrication work to a B2B customer on agreed credit terms, all goods
remain the property of Tigweld4u Limited until payment has been received in
full.
This applies even after the goods have been
delivered to the B2B customer.
Until payment has been received in full,
the customer must:
- take reasonable care of the goods;
- keep the goods identifiable as our
property where reasonably practicable; and
- not intentionally remove or obscure
identifying marks.
Where payment becomes overdue, Tigweld4u
Limited reserves its rights concerning unpaid goods, subject to applicable
law.
This retention-of-title provision applies
to B2B transactions and does not restrict consumer statutory rights.
20. Third-Party Charges
Unless expressly agreed in writing in
advance, we do not accept responsibility for third-party charges incurred
by a customer in connection with our products.
This includes:
- garage bills;
- mechanic or fitting charges;
- labour charges;
- vehicle recovery charges;
- storage charges;
- diagnostic charges;
- loss of earnings; and
- other third-party costs.
Customers should not incur such costs on
the assumption that they will be reimbursed unless we have expressly agreed
this in writing.
Nothing in this clause excludes liability
that cannot legally be excluded or limits mandatory consumer rights.
21. Returns, Refunds and
Cancellations
Our detailed provisions regarding returns,
refunds, cancellations, restocking charges and warranty claims are
contained in our separate:
Returns, Refunds, Cancellations &
Warranty Policy
22. Twelve-Month
Warranty
We provide a 12-month warranty on
qualifying:
- standard stock products, including
taxi parts; and
- modified standard parts.
The warranty does not apply to fully
bespoke parts or fabrication work unless expressly agreed otherwise in
writing.
The warranty is additional to statutory
rights.
23. B2B Fabrication
Cancellation
B2B fabrication work is bespoke.
Once production has commenced, cancellation
will generally only be accepted at our discretion.
Where cancellation is accepted, reasonable
costs already incurred may be charged, including materials, labour,
third-party services, preparation, carriage and other reasonable costs
directly associated with the order.
24. Intellectual
Property
Unless otherwise agreed, copyright and
other intellectual property rights in our website content, photographs,
graphics, designs, text and other materials remain the property of the
relevant company or its licensors.
25. Liability
Nothing in these Terms excludes or limits
liability that cannot legally be excluded or limited.
This includes liability for death or
personal injury caused by negligence, fraud or fraudulent misrepresentation
and mandatory consumer rights.
Subject to the above, liability will be
determined in accordance with applicable law and the nature of the
contract.
26. Privacy
Personal information is handled in
accordance with our Privacy Policy.
27. Cookies
Our website uses cookies and similar
technologies. Details are provided in our Cookie Policy.
28. Governing Law
These Terms are governed by the law of
England and Wales, subject to any mandatory rights applicable to consumers.
