RETURNS, REFUNDS, CANCELLATIONS & WARRANTY POLICY

This policy applies to products supplied by Tigweld4u Limited and Tigweld4u Customs Limited.

Nothing in this policy limits or excludes consumer statutory rights that cannot legally be excluded.

1. Standard Stock Items

Only standard stock items are currently available for direct online purchase.

Most standard stock items are made to order following purchase but remain standard stock items because they are supplied without modification to the customer's individual specifications.

Modified and fully bespoke products are not available for direct online purchase.

2. Consumer Purchases

Consumers have statutory rights under applicable UK consumer law.

Where goods are faulty, defective, damaged, incorrectly supplied, misdescribed or otherwise fail to conform to the contract, statutory remedies may include repair, replacement, price reduction or refund depending on the circumstances.

These statutory rights apply independently of our 12-month warranty.

3. Consumer Online Cancellation Rights

Where a qualifying consumer purchases a standard stock item online, the consumer will generally have a statutory right to cancel without giving a reason.

The cancellation period normally lasts for 14 days from the day after the goods are received.

After notifying us of cancellation, the consumer normally has a further 14 days to return the goods.

The consumer is generally responsible for the direct cost of returning the goods unless we have agreed otherwise or the law requires us to pay.

4. Consumer Refunds

Where a consumer validly exercises their statutory cancellation right:

  • we will refund the payments required by law;
  • the refund will normally include the cost of our least expensive standard delivery option;
  • any additional amount paid for a more expensive delivery service does not normally have to be refunded;
  • refunds will normally be made using the original payment method; and
  • where permitted by law, we may wait until goods are returned or evidence of return is provided.

Refunds will be made within the period required by law.

5. Consumer Restocking Charges

We do not apply an automatic restocking fee to consumers exercising their statutory cancellation rights.

Where permitted by law, a reasonable deduction may be made if goods have been handled beyond what is reasonably necessary to establish their nature, characteristics and functioning and this has reduced their value.

No restocking charge will be used to reduce a statutory remedy for faulty, defective, damaged, incorrectly supplied or non-conforming goods.

6. B2B Returns

The statutory consumer cancellation regime does not generally apply to B2B purchases.

A B2B customer does not automatically have a right to return a correctly supplied standard stock item simply because it is no longer required.

Where we agree to accept a discretionary B2B return, we may apply a restocking charge of up to 20%.

The actual charge will depend on the circumstances and may reflect reasonable costs associated with:

  • return administration;
  • inspection;
  • cleaning;
  • repackaging;
  • handling;
  • restoring the product to saleable condition; and
  • other reasonable return costs.

We will advise the customer of the applicable charge before authorising the return.

A restocking charge will not be used to avoid a legally required remedy for faulty, defective, incorrectly supplied or non-conforming goods.

7. Damaged Deliveries

Customers should inspect goods as soon as reasonably practicable after delivery.

Where goods are visibly damaged on arrival, customers should:

  1. notify the courier;
  2. record the damage with the courier where possible;
  3. photograph the packaging;
  4. photograph the damaged goods; and
  5. contact us promptly.

Customers should retain packaging until we have advised whether it is required.

Goods sent by courier are insured against loss or damage during transit, subject to the applicable courier or transport insurance terms.

For consumers, failure to record damage with the courier does not automatically remove statutory rights.

8. Faulty, Defective, Incorrect or Misdescribed Goods

Please provide:

  • order number;
  • name;
  • contact details;
  • description of the problem; and
  • photographs or other relevant evidence where reasonably available.

We may require reasonable evidence or ask for the goods to be returned for inspection.

9. Consumer Short-Term Right to Reject

Consumers generally have a statutory short-term right to reject goods that do not conform to the contract within 30 days of delivery, subject to applicable law and any relevant exceptions.

Where applicable, the consumer may be entitled to a refund.

10. Repair or Replacement

Where a statutory right to repair or replacement applies, we will provide the applicable remedy in accordance with the law.

Where repair or replacement is impossible, disproportionate, unsuccessful or cannot be completed within a reasonable time, further statutory remedies may apply.

11. Standard Items Ordered in Error

If a standard stock item has been ordered in error, contact us immediately.

If the order has not yet been dispatched, we may be able to cancel it.

Consumer statutory cancellation rights remain applicable where they apply.

For B2B customers, cancellation is subject to the agreed terms.

12. Modified Stock Items

Modified stock items cannot currently be purchased online.

Customers wishing to modify a standard product must contact us.

The cancellation and return position will depend upon the agreed specification and whether the customer is a consumer or B2B customer.

Where goods are genuinely made to the customer's specifications or clearly personalised, the statutory distance-selling cancellation exemption may apply.

This does not remove statutory rights relating to faulty or non-conforming goods.

13. Fully Bespoke Products

Fully bespoke products are not available for direct online purchase.

They are manufactured following discussion and agreement of the customer's requirements.

Where a consumer purchases qualifying bespoke goods made to their specifications or clearly personalised, the normal 14-day cancellation right may not apply.

For B2B customers, bespoke work is subject to the agreed contractual terms.

14. B2B Fabrication

Fabrication work undertaken by Tigweld4u Limited for B2B customers is treated as bespoke.

This includes goalpost door protection where the goalposts are manufactured to dimensions supplied by the customer.

Quotations will include, where applicable:

  • item cost;
  • delivery cost based on location, size and weight;
  • manufacturing lead time; and
  • estimated delivery time.

Large fabricated items may be transported using subcontracted haulage companies or specialist transport providers.

15. B2B Fabrication Credit

B2B fabrication work may be supplied on credit only where Tigweld4u Limited has expressly agreed credit terms in writing.

Bank-transfer details are provided on invoices.

Where credit has not been expressly agreed, payment arrangements will be specified in the quotation or invoice and goods will not be supplied on credit.

16. Retention of Title

Where Tigweld4u Limited supplies B2B fabrication work on agreed credit terms, all goods remain the property of Tigweld4u Limited until payment has been received in full.

This applies even after delivery.

The customer must take reasonable care of the goods and keep them identifiable as our property where reasonably practicable until ownership passes.

Where payment becomes overdue, Tigweld4u Limited reserves its rights concerning unpaid goods, subject to applicable law.

17. Third-Party Garage and Labour Charges

We do not accept responsibility for third-party charges incurred by customers unless expressly agreed in writing in advance or liability cannot legally be excluded.

This includes:

  • garage bills;
  • mechanic or fitting charges;
  • labour charges;
  • vehicle recovery;
  • storage;
  • diagnostic charges;
  • loss of earnings; and
  • other third-party expenses.

Customers should not incur such costs on the assumption that they will be reimbursed unless we have expressly agreed this in writing.

18. Twelve-Month Warranty

We provide a 12-month warranty on:

  • standard stock products, including taxi parts; and
  • modified standard parts.

The warranty does not apply to fully bespoke parts or fabrication work unless expressly agreed otherwise in writing.

The warranty is additional to statutory consumer rights.

19. Warranty Exclusions

The warranty does not normally cover:

  • normal wear and tear;
  • misuse;
  • incorrect installation;
  • accident or impact damage;
  • unauthorised modification;
  • neglect;
  • use outside the intended application; or
  • failure to follow supplied installation or use instructions.

These exclusions do not restrict statutory rights that cannot legally be excluded.

20. Warranty Returns

Where a voluntary warranty claim requires an item to be returned to us, the customer may be responsible for the cost of sending the item to us.

Where a warranty claim is accepted, we will cover the cost of sending a repaired or replacement item back to the customer.

Where statutory rights apply instead, the statutory rules regarding return costs will apply.

21. Returns Address

Where we instruct a customer to return an item, the normal return address is:

We may provide alternative instructions where appropriate.

22. Unauthorised Returns

Please contact us before returning an item wherever reasonably possible.

This allows us to identify the order and provide appropriate instructions.

Nothing in this section restricts a consumer's statutory rights.

23. Original Packaging

We recommend retaining the original packaging until the product has been checked and confirmed satisfactory.

For consumer statutory claims, lack of original packaging will not automatically remove statutory rights where the law does not permit such a restriction.
